A redefinição da natureza jurídica dos animais no Brasil

Abstract

The social movement for the welfare and rights of animals is growing not only in Brazil, but in the world. And the tendency is that this choir will increase, mainly in reason of the denunciations of daily maltreatment published in the most varied social networks. Before a progressive setting, the current juridical nature of animals in Brazil, moving things/goods that move by themselves, has been questioned by theories that pass through the fields of philosophy, ethics, sociology and the law itself, in the search for a solution that makes effective the guardianship of non-humans in the country. In this harvest, we highlight the Theories of Personification and the Theory of the Intermediate Status of Animals, which together with the Abolitionist and Reformist Theories have provoked significant changes in European Private Law and warm debates in Brazilian scientific publications.
