| Zusammenfassung: | The rescission action is provided in the Code of Civil Procedure with an exhaustive role of suitability. The doctrine, as well as the Courts through the judgment in repeated cases and, consequently, statements of precedents, are responsible for promoting the interpretation of them. Thus, the purpose of this research is to study the doctrinal currents regarding the limits of application of Statement No. 343 of the Supreme Court, in other words, to what extent the change of understanding of the courts generates the right to rescission under the legal basis of Article 966, V, of the Civil Procedure Code of 2015, given its new premises. |
| Beschreibung: | A ação rescisória é prevista no Código de Processo Civil com rol taxativo de hipóteses de cabimento. A doutrina, bem como os tribunais por meio do julgamento em casos reiterados e, consequentemente, enunciados de súmulas, são responsáveis por promover a interpretação delas. Assim, o objetivo desta pesquisa volta-se a estudar as correntes doutrinárias a respeito dos limites de aplicação do Enunciado nº 343 da Súmula do STF, ou seja, até que ponto a viragem de entendimento das cortes gera direito à rescisão sob o fundamento legal do artigo 966, V, do Código de Processo Civil de 2015 (CPC/2015), dadas as suas novas premissas. |
