| metadata.dc.description.resumo: | O presente estudo tem como finalidade, em linhas gerais, a análise de como a inserção de algoritmos de inteligência artificial em processos de tomada de decisões, implica no acesso à certos direitos, focando essencialmente na possibilidade de discriminação por esses algoritmos e como isto é disciplinado no direito brasileiro. Para isso, são apresentados os conceitos de inteligência artificial, algoritmos e decisões automatizadas, além dos princípios que regem o tema e a evolução do tratamento dado à matéria nas principais legislações nacionais e internacionais, em especial à Lei Geral de Proteção de Dados, sob o recorte da alteração promovida pela Medida Provisória nº 869/2018 e o Regulamento Geral sobre a Proteção de Dados europeu. |
| Abstract: | This study aims, in general terms, to analyze how the insertion of artificial intelligence algorithms in decision-making processes implies access to certain rights, focusing mainly on the possibility of discrimination by these algorithms and how this is regulated in Brazilian law. To this end, the concepts of artificial intelligence, algorithms and automated decisions are presented, in addition to the principles that govern the topic and the evolution of the treatment given to the matter in the main national and international legislations, especially the General Law of Data Protection, under the cutout of the change promoted by Provisional Measure N. 869/2018 and the European General Data Protection Regulation. |
