A competência do Tribunal Penal Internacional em crimes ambientais que violam Direitos Humanos: análise da possibilidade (ou não) de Admissibilidadedo do Caso Belo Monte

Abstract

After centuries of unconstrained exploration of natural resources, the planet starts to show signs of collapse and, not infrequently, with serious consequences upon human communities. The concern with that kind of phenomena fomented the develpment of systems of ambiental protection and human rights, wich gradually influenced and complementing themselves. In 2016 the convergence of those systems can be observed in the scope of the International Criminal Court, when the Prosecutor's Office (organization linked to the Court), by official doccument, revealed explicitly expressing the understanding that certain environmental crimes (of great proportions) are crimes under jurisdiction of the Court and tha will be given to them special attention in selection and prioritization in cases of investigation. Based on this new perspective, it is sought to evaluate the possibility of cases in violation of human rights caused by the implementation of the hydroelectric power plant of Belo Monte to be admitted and processed by the International Criminal Court.
