| Resumo: | O presente trabalho é uma pesquisa bibliográfica acerca do efeito backlash na definição da natureza jurídica do rol de procedimentos e eventos em saúde suplementar elaborado pela Agência Nacional de Saúde Suplementar. Primeiro o estudo aborda a origem, o conceito, os elementos e as formas de exteriorização do backlash. Em seguida a pesquisa descreve os fatos relacionados ao debate sobre a natureza jurídica do rol de procedimentos e eventos em saúde suplementar. Por último, apresenta-se a aplicação das definições gerais do backlash na compreensão das reações sociais e legislativas contra a taxatividade do rol de procedimentos e eventos em saúde suplementar definida pelo Superior Tribunal de Justiça. |
| Abstract: | The present work is a bibliographical research about the backlash effect in the definition of the legal status of the list of procedures and events in supplementary health prepared by the Brazilian Supplementary Health Agency. First, the research presents the origin, concept, elements and forms of exteriorization of the backlash. Then the research describes the facts related to the debate on the legal status of the list of procedures and events in supplementary health. Finally, the application of the general definitions of the backlash is presented in the understanding of social and legislative reactions against the exhaustiveness of the list of procedures and events in supplementary health defined by the Brazilian Superior Court of Justice. |
