| Resumo: | O processo licitatório no Brasil é regido pela Lei n° 8.666/1993 e em anos de aplicação desta legislação, várias normativas foram adicionadas em complemento, tais como: a Lei n° 10.520/2002 - Lei do Pregão e a Lei 12.462/11 - Lei do Regime Diferenciado de Contratações (RDC), entretanto, sob a justificativa de defasagens e burocracia excessiva presentes nas normas anteriormente citadas, em 01 de abril de 2021 foi promulgada a Lei n° 14.133/2021, gerando expectativa dos gestores e agentes públicos que efetuam os processos licitatórios, portanto, o presente estudo tem como objetivo investigar as perspectivas desta nova lei, através de pesquisa bibliográfica percorrendo a evolução do processo licitatório e as contribuições da Lei do Pregão e RDC à Lei Geral de Licitações, findando nas principais mudanças da nova lei de Licitação, bem como a convergências e divergências de autores sobre a eficácia desta. Por conseguinte, foi possível observar uma perspectiva positiva frente as visões dos autores e especialistas, pois a Lei n° 14.133/2021 busca operar a licitação a vista de uma boa governança pública, ainda que exista burocracia em sua estrutura. |
