| metadata.dc.description.resumo: | A violência obstétrica é um problema de saúde pública relevante e que deve ser erradicado da sociedade. Além da violência obstétrica, o Covid-19 surgiu, em âmbito global, como um outro problema de extrema relevância. Identificados os direitos fundamentais das mulheres, no que concerne à maternidade, e compreendida a pertinência do assunto humanização do parto e nascimento percebeu-se que alguns desses direitos foram relativizados, no período de pandemia de Covid-19, e em determinados casos, o direito foi completamente ignorado por hospitais e até por profissionais de saúde. Sendo assim, a partir da observação do posicionamento do ordenamento jurídico brasileiro, através de leis, jurisprudência e literatura, foi possível observar, a partir do estudo da responsabilidade civil, de que forma os agressores dos casos ocorridos podem ser responsabilizados. |
| Zusammenfassung: | Obstetric violence is a relevant public health problem that must be eradicated from society. In addition to obstetric violence, Covid-19 emerged, globally, as another extremely important issue. Identifying the fundamental rights of women, with regard to motherhood, and understanding the pertinence of the subject humanization of childbirth and birth it was noticed that some of these rights were relativized, during the Covid-19 pandemic, and in certain cases, the right was completely ignored by hospitals and even health professionals. Therefore, from the observation of the position of the Brazilian legal system, through laws, jurisprudence and literature, it was possible to observe, from the study of civil liability, how the aggressors of the cases that occurred can be held accountable. |
