metadata.dc.description.resumo: Desenvolver, gerar empregos, atrair investimentos e preservar a natureza no Estado do Amazonas sempre foi tarefa árdua. O modelo de desenvolvimento do Estado é essencialmente jurídico, haja vista o Decreto-Lei n. 288/67 que criou a Zona Franca de Manaus. Entretanto a ZFM não tem apenas aspectos positivos. As externalidades prejudiciais da ZFM incomodam diariamente os moradores locais com escassez de produção de alimentos no interior do Estado, forte crescimento demográfico da capital e ocupação urbana desordenada, devastação de áreas de florestas nos arredores da capital amazonense etc. O objetivo desse trabalho é analisar a lei de incentivos tributários n. 2826/2003 do Amazonas à luz do socioambientalismo, haja vista a necessidade de se promover o desenvolvimento socioeconômico além dos limites da capital Manaus. A partir dessa análise pretende-se responder às seguintes perguntas: Essa lei tem caráter socioambiental? E ainda, precisa contemplar as comunidades tradicionais e indígenas do Estado? Quais instrumentos jurídicos poderiam contribuir para implementar o socioambientalismo? Serão abordadas as questões sociais relacionadas ao meio ambiente, pois a Região Amazônica apresenta características peculiares que a torna ímpar, exigindo políticas públicas e soluções jurídicas específicas para esse contexto socioambiental. A ZFM foi criada por um dispositivo legal de indução econômica, de forma que o desenvolvimento econômico da região está estruturado em um ordenamento jurídico aplicável somente ao Amazonas. Emprestando o conceito da extrafiscalidade, será feita uma reflexão acerca da possibilidade de normas tributárias induzirem o socioambientalismo na região para conformar o atual modelo de desenvolvimento aos preceitos constitucionais. A lei estadual n. 2826/2003 tem como escopo principal a desoneração do ICMS na produção e comercialização dos produtos da ZFM e tem cumprido seu papel de atrair investimentos para a região. O governo pode aplicar os “créditos verdes” para promover a sustentabilidade do Estado em coordenação com os projetos de créditos de carbono. A norma precisa promover práticas ecologicamente saudáveis, socialmente justas e economicamente viáveis. Por todo o exposto acima, justifica-se essa pesquisa, especialmente pelo fato de a ZFM ter sido prorrogada até 2073 ex vi da EC n. 83/2014. A diversificação da matriz econômica local é crucial para a futura estabilidade do Estado, que não pode menosprezar o desenvolvimento do seu interior, devendo conduzi-lo de forma sustentável e com apoio da sociedade. Este trabalho segue uma abordagem interdisciplinar, característica do Direito Ambiental. A metodologia empregada foi a pesquisa bibliográfica com método indutivo, partindo-se da análise do socioambientalismo e do fenômeno da extrafiscalidade tributária para o caso geral do norma isentiva estadual, meio de direcionar o desenvolvimento para o interior do Estado. Apoiada na doutrina, legislação e jurisprudência, notícias da mídia e a experiência do autor em seu trabalho de auditoria tributária no PIM desde o ano de 2005. Zusammenfassung: Develop, create jobs, attract investments and preserve nature in the Amazonas state has always been tough. The state development model is essentially legal, given the Decree-Law no. 288/67 that created the Manaus Free Trade Zone. However the ZFM has not only positive aspects. Harmful externalities ZFM daily annoy the locals with shortages of food production in the state, strong demographic growth of the capital and unplanned urban occupation, devastation of forest areas around the capital of Amazonas etc. The aim of this study is to analyze the law of tax incentives n. 2826/2003 of the Amazon in the light of socio-environmentalism, given the need to promote socio-economic development beyond the limits of Manaus capital. Based on this analysis aims to answer the following questions: This law has socio-environmental? And also you need to consider the traditional communities and indigenous state? What legal instruments could help to implement socioenvironmentalism? social issues related to the environment will be addressed as the Amazon region has unique features that makes it unique, demanding public policies and specific legal solutions to this environmental context. The ZFM was created by a legal provision of economic inductance, so that the region's economic development is structured in a legal system applicable only to the Amazon. Borrowing the concept of extrafiscality, a reflection on the possibility of tax rules induce socioenvironmentalism in the region to conform to the current model of development to the constitutional provisions will be made. State law n. 2826/2003 has as main purpose the exemption of ICMS in the production and marketing of products in the ZFM has fulfilled its role of attracting investment to the region. The government can apply the "green credits" to promote the sustainability of the State in coordination with the carbon credit projects. The standard needs to promote ecologically sound, socially just and economically viable practices. For all the above, this research is justified, especially because the ZFM have been extended until 2073 ex vi CE n. 83/2014. This work follows an interdisciplinary approach, characteristic of environmental law.
