dc.descriptionO presente trabalho procura demonstrar como a prática da alienação parental tem se revelado um verdadeiro empecilho para o pleno cumprimento do princípio do melhor interesse do menor, mais precisamente no que diz respeito à fruição do direito constitucional de convivência familiar, bem como as consequências danosas da referida prática para o infante. Para atingimento deste objetivo, utilizamos o método indutivo e a técnica de revisão bibliográfica, tomando como base os livros e artigos jurídicos, pesquisas científicas publicadas sobre o tema e os julgados mais recentes dos nossos tribunais no tocante à Lei nº 12.318/2010. Discorre-se primeiramente sobre a dissolução da sociedade conjugal e suas consequências para os filhos. Tratamos também sobre o poder familiar, o instituto da guarda e os tipos legalmente previstos. Logo após, destacamos a relevância do princípio do melhor interesse do menor e seu reflexo sobre a vida e dignidade dos infantes. Elencamos ainda os dispositivos nacionais e internacionais que consagram os direitos do menor e garantem o convívio saudável com familiares, principalmente seus genitores, mesmo após a dissolução da sociedade conjugal. Por fim, apresentamos as informações levantadas nos meios científicos e jurídicos sobre a alienação parental, seu conceito, características e efeitos danosos para os infantes, ao mesmo tempo em que analisamos a forma como nossos tribunais tem se posicionado diante dos casos de alienação parental e como a Lei nº 12.318/2010 tem sido aplicada de modo a garantir a efetividade do princípio do melhor interesse do menor, através da coibição de referida prática.pt_BR
dc.description.abstractThis paper aims at demonstrating how the practice of parental alienation has proved to be a real obstacle to full compliance with the principle of the best interest of the minor, more precisely with respect to the enjoyment of the constitutional right to family life, as well as the harmful consequences of practice for the infant. To achieve this goal, we use the inductive method and the bibliographic review technique, based on the books and legal articles, published scientific research on the subject and the most recent court judgments regarding Law nº 12.318/2010. It is first discussed on the dissolution of the conjugal society and its consequences for the children. We also deal with family power, guardian institute and legally foreseen types. Soon after, we emphasize the relevance of the principle of the best interest of the minor and its reflection on the life and dignity of the infants. We also list national and international provisions that consecrate the rights of the minor and ensure healthy living with family members, especially their parents, even after the dissolution of the conjugal society. Finally, we present the information collected in the scientific and legal circles about parental alienation, its concept, characteristics and harmful effects for infants, while analyzing the way in which our courts have positioned themselves in cases of parental alienation and how Law nº 12.318/2010 has been applied in order to guarantee the effectiveness of the principle of the best interest of the minor, through the restriction of said practice.pt_BR
