| Abstract: | The present article proposes to critically examine the grounds and validity before the legal order of the figure of the total prescription, enshrined in Precedent no. 294 and, currently, also in art. 11, paragraph 2, of the CLT, inserted by Law 13467/17, which extended its coverage to the hypotheses of noncompliance with the agreement. |
| Description: | O presente artigo propõe-se a examinar criticamente os fundamentos e a validade perante o ordenamento jurídico da figura da prescrição total, consagrada na Súmula n.º 294 e, atualmente, também no art. 11, §2º, da CLT, inserido pela Lei nº 13.467/17, que estendeu sua abrangência às hipóteses de descumprimento do pactuado. |
