Responsabilidade civil do empregador: teorizando com as possibilidades constitucionais

Abstract

This article aims to highlight the applicability of subjective or objective civil liability of the employer, depending on the violation of the subjective rights of employees in relation to the employer's obligation to maintain a balanced working environment. In order to do so, it will seek to interpret the constitutional norms directed to the working environment in order to show how, in what situations and under what conditions, the objective liability of the employer may occur. The research method is the legal theory and the research technique used was the bibliographical one.
